Florida’s 25% Rule: What Homeowners Need to Know

For years, Florida’s building code enforced the strict “25% Rule.” If more than 25% of your roof needed repairs or replacement within a 12-month period, the entire roof had to be upgraded to current code standards, often forcing a full replacement even if the rest was solid.

In 2022, Senate Bill 4-D modified this rule significantly. Now, if your roof was built or replaced after March 1, 2009, and complies with the 2007 Florida Building Code or later, you can repair any portion without triggering a full replacement. Only the fixed area must meet current code. This has saved countless South Florida homeowners thousands by allowing targeted repairs over total overhauls.

While the building code is more flexible, insurance companies have tightened up. Under 2025 updates like Senate Bill 76 and related laws, many insurers can now deny or non-renew policies for roofs 15 years or older, or for those showing wear. All repairs must still comply with the latest Florida Building Code for permits, safety, and insurability.

For most homeowners it is a 2-to-1 match: the state kicks in $2 for every $1 you spend, up to $10,000. Low-income households at or below 80% of area median income get the full $10,000 with no match required.
